Electorates of Embakasi North Constituency might be warming for a by election after their MP James Gakuya was implicated in ksh 40million CDF scandal a week ago.
The anti-corruption agency stated Gakuya is being investigated for misappropriation of funds allocated for road construction for the financial year 2014-2015.
According to EACC, the MP awarded his companies tenders worth millions of shillings for the construction of non-existence road structures.
“Investigations established that three companies associated with the Embakasi North Member of Parliament were James Mwangi Gakuya were awarded contracts for the construction of roads in Embakasi North Constituency. The companies in which Hon. Gakuya is a signatory to the bank accounts were paid a total of Ksh 40 million,” the statement read.
This isn’t the first time for Gakuya to be charged in the court of law implicated in crimanal cases ranging from misappropriation of funds to obtaining money by false pretense.
In 2015, Gakuya was also charged after he defrauded former Makadara MP Benson Mutura Sh7 million by pretending he could sell a piece of land.
In 2017, the Mp was battling to retain his seat after his bitter rival Harrison Wangoro Mwangi trounced him during jubilee nominations but he was controversy awarded the certificate by the Court.
Contacted his nemesis hon Wangoro didn’t comment on 2017 election mishaps but said that elected leaders must be held accountable of public resources.
Wangoro urged leaders to uphold, defend and obey the Third schedule of the constitution regarding fairness in administrative actions.
“I would like to call for any leader who is implicated in any scandal to step down to allow the investigation as we can’t afford on losing money in the name of development, “He said urging president Uhuru, ODPP and EACC not to spare anyone on the fight against corruption.
The constitutional act states that a Member of Parliament may be recalled where the member is found (upon a judgment or finding by the High Court) to have violated the provisions of Chapter Six of the Constitution or is found to have mismanaged public resources.
Embakasi locals are calling for the freezing of the CDF account till the case filed against the Mp is determined.
